By accessing our Site, booking a session, or engaging our coaching, counselling, retreat, or workshop services, you ("you" or "Client") agree to be bound by these Terms. If you do not agree, please do not use our Site or engage our services.
These Terms are governed by the laws of Victoria and the Commonwealth of Australia, including (but not limited to) the Competition and Consumer Act 2010 (Cth) (incorporating the Australian Consumer Law), the Fair Trading Act 2012 (Vic), and the Privacy Act 1988 (Cth).
Empowering Philosophy provides philosophical counselling, executive coaching, personal development programmes, contemplative retreats, reading circles, and corporate workshops. Our services draw on the Western, Eastern, and contemporary philosophical traditions.
Important: Our services are philosophical and educational in nature. They are not a substitute for psychological, psychiatric, medical, legal, financial, or other professional advice. We do not diagnose or treat mental illness or clinical conditions.
If in the course of an engagement it appears that clinical support would be more appropriate, we will recommend referral to a suitably qualified professional. You retain responsibility for decisions about your own life, health, and circumstances.
You may access and use the Site for lawful personal or business purposes in accordance with these Terms. You must not:
All engagements are subject to acceptance by Empowering Philosophy and the availability of the relevant practitioner. Fees are quoted in Australian Dollars (AUD) and may be subject to Goods and Services Tax (GST) under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

We reserve the right to reschedule sessions where a practitioner is unavailable due to illness or emergency. In such cases, an equivalent alternative will be offered at no additional cost.
All individual sessions are held in professional confidence in accordance with our Privacy Policy and the ethical guidelines of the American Philosophical Practitioners Association (APPA). We will not disclose session content or the fact of your engagement without your explicit consent, except where disclosure is required by Australian law or where there is a serious and imminent risk to life or safety.
In group settings (reading circles, retreats, workshops), participants are expected to respect each other's confidentiality; however, we cannot guarantee the conduct of third-party participants.
All intellectual property rights in the content of the Site — including text, graphics, logos, programme materials, reading lists, and journal prompts — are owned by or licensed to Empowering Philosophy. You are granted a limited, personal, non-transferable licence to use programme and retreat materials solely for your own reflection and development.
You must not reproduce, publish, or commercially exploit our materials without our prior written consent. Recording of sessions (audio or video) is only permitted with the practitioner's explicit prior consent.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded or limited.
Where our services are supplied to a consumer under the ACL, you may have consumer guarantees including that services are rendered with due care and skill and are reasonably fit for the specified purpose.
To the extent permitted by law, our liability for a breach of a non-excludable consumer guarantee is limited (at our election) to resupply of the services or payment of the cost of resupply.
Subject to clause 9 and to the fullest extent permitted by law:
You agree to indemnify, defend, and hold harmless Empowering Philosophy, its directors, officers, employees, and agents from any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from:

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
We may update these Terms at any time by publishing the revised version on our Site. The revised Terms will be effective from the date of publication. Continued use of the Site or our services after changes are published constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
Failure by Empowering Philosophy to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms, together with any engagement letter, Statement of Work, programme booking confirmation, and our Privacy Policy, constitute the entire agreement between you and Empowering Philosophy with respect to your use of the Site and our services, superseding all prior agreements, representations, and understandings.
These Terms are governed by and construed in accordance with the laws of Victoria and the Commonwealth of Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria (and any relevant appellate courts) for the resolution of any disputes arising under or in connection with these Terms.
